Terms of Service

These terms cover your use of the Buzy Bay website and application. If your organisation has signed a separate written agreement with us, that agreement governs where the two differ.
The service
Buzy Bay is a hosted work-management platform for vehicle service departments: booking appointments against real shop capacity, tracking part requests, running the shop floor, and closing out the month. We provide it as a subscription service, and we may improve or change how features work over time.
Accounts and access
Accounts are granted through a subscribing organisation. Sign-in is passwordless: we email a one-time code to your work address, and access is limited to email domains the organisation has approved.
Keep your email account secure, since anyone with access to it can request a sign-in code. Tell us promptly if you believe an account has been misused. Organisations are responsible for who they grant access to, and for what their users do in the application.
Your data stays yours
The information your organisation enters stays yours: work orders, vehicles, customer contacts, comments, configuration. You grant us the right to host and process it in order to run the service, and to build and improve features for it. That can include automated assistance learned from past records, such as suggesting complaints or estimating how long a job will take. We do not sell your data, and we do not use it to advertise to you or to anyone else.
You are responsible for having the right to put that information into the service, including any personal information about your own customers and employees. How we handle it is described in our Privacy Policy.
Acceptable use
You agree not to:
- use the service unlawfully, or to store unlawful or infringing content;
- attempt to access another organisation's data, or probe, scan or test the security of the service without our written permission;
- interfere with the service's operation, or place an unreasonable load on it through automated means;
- resell or provide the service to a third party without our agreement.
Fees
Fees, billing period and scope are set out in the written agreement or order with your organisation. Unless that agreement says otherwise, fees are payable in advance and exclude applicable taxes.
Availability and support
We aim to keep the service available and to respond promptly to problems, and our agreement with your organisation may set out specific support commitments. We do occasionally need to perform maintenance, and we will avoid busy shop hours where we can.
Confidentiality
Working together means each of us sees things the other keeps private. We see how your shop runs and the records your team enters. You may see how our software works, what we charge, and features we have not released yet.
Neither of us will use the other's private information for anything beyond running the service, or pass it to people who do not need it, and each of us will protect it with the same care we would give our own.
Intellectual property
We own the software, the interface and the Buzy Bay name and marks. These terms grant you the right to use the service, not to copy, decompile or create derivative works from it.
Ending the agreement
Either party may end the subscription in line with the written agreement. You may request an export of your data before it ends, and on request we will delete it afterwards, subject to any retention the law requires of us. We may suspend access if an account is being used in a way that breaks these terms or endangers the service, and we will tell you why.
Disclaimers and liability
The service is provided as it is. Buzy Bay is a planning and record-keeping tool: it supports the judgement of the people running the shop, it does not replace it. You remain responsible for your operational decisions and for meeting your own obligations to your customers.
To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits or revenue. Any specific liability limits agreed in writing with your organisation apply.
Changes to these terms
If we change these terms we will update the date at the top of this page, and for material changes we will notify subscribing organisations. Continuing to use the service after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. The courts of Québec have exclusive jurisdiction over any dispute arising from them, and each of us submits to those courts.
